The aim of this study is to characterize the weak discussion about the Human Rights in Franco’s time, not in general, but by testing Vallet de Goytisolo’s works. This author is deeply influenced by the lectures of M. Villey, Parisinian philosopher well-known by his denial of Human Rights. A comparative study of these authors will be done focusing on two - faced aspects : the strength and fragility of their doctrines. Both authors are defined as supporters of the Methodical Realism (...) (Aristotelian-Thomist school), although their arguments and sources are very similar, their purposes and conclusions are different. Juan Vallet does not reject the Human Rights, but he prefers the denomination of ethical-legal principles, that is, moral categories that must guide the legislative and judicial praxis. The root of these ethical-legal principles is the ethical-natural principles extracted at natural order, and the duty of all authority is to adequate his rules to the nature of things, exactly as in Saint Thomas. In Vallet’s works, the theoretical reason for this rejection is that the notion of fundamental right is scientifically unsatisfactory to understand the complexity of the social reality. The practical reason defends that the Civil right should not be confused with the power or faculty of the individual, errors of nominalism, but the origin of these powers is to be found in the context of a particular legal relationship. However, in the end, this catalogue of rights will be not feasible for the citizen, since these rights are at the mercy of the legislator or the judge. Este trabajo parte de una revisión completa del periódico para mujeres La Educanda (Madrid, 1861-1865), que permite apreciar las variaciones existentes en las dos épocas que conoce en su andadura y muestra de manera clara cómo pese a ser una publicación dirigida por hombres, en sus páginas va creciendo de manera notable la participación femenina, coincidiendo con una tendencia generalizada a visibilizar el papel de las mujeres editoras y escritoras en muchas de las empresas de la década de los sesenta.

BackgroundInformed consent is a key element of ethical clinical research. Addicted population may be at risk for impaired consent capacity. However, very little research has focused on their comprehension of consent forms. The aim of this study is to assess the capacity of addicted individuals to provide consent to research.Methods53 subjects with DSM-5 diagnoses of a Substance Use Disorder and 50 non psychiatric comparison subjects participated in the survey from December 2014 to March 2015. This cross-sectional study was carried out (...) at a community-based Outpatient Treatment Center and at an urban-located Health Centre in Spain. A binary judgment of capacity/incapacity was made guided by the MacArthur Competence Assessment Tool for Clinical Research and a clinical interview. Demographics and clinical characteristics were assessed by cases notes and the Mini-Mental State Examination, the Global Assessment Functional Scale and the Clinical Global Impression Scale.ResultsNPCs performed the best on the MacCAT–CR, and patients with SUD had the worst performance, particularly on the Understanding and Appreciation subscales. 32.7 % SUD people lacked research-related decisional capacity. There were no statistically significant differences between the groups in terms of capacity to consent to research.ConclusionsThe findings of our study provide evidence that a large proportion of individuals with SUD had decisional capacity for consent to research. It is therefore inappropriate to draw conclusions about capacity to make research decisions on the basis of a SUD diagnosis. In the absence of advanced cognitive impairment, acute withdrawal or intoxication, we should assume that addicted persons possess decision-making capacity. Thus, the view that people with SUD would ipso facto lose decision-making power for research consent is flawed and stigmatizing. (shrink)

The Communicational Theory of Law (CTL) usually differentiates between Legal Sociology and Legal Theory, in the sense that Legal Sociology is concerned with the social validity of the rules and Legal Theory with the formal or legal validity of the rules. It can be argued that both disciplines are two different perspectives of the same empirical reality (legal rules). Also, legal System and social milieu are two closely linked realities; they cannot be separated because they need each other. The Law (...) is the form or order that the social milieu takes, and, at the same time, the social environment provides the ideas, collective representations and other matters that need a legal regulation. For this reason, the epistemological separation between Sociology and Legal Theory must be overcome when the theoretical perspective comes to legal decisions. Thus, the decisional moment becomes the meeting point between the legal System and the social milieu. This is where the concept of the legal System fulfils its main function, as it allows for the dynamism and adaptability of the legal order. The hermeneutic re-elaboration of the normative texts will be the channel through which the social facts and other material elements can inform the meaning or possible interpretations of the rules and institutions of the legal order. This happens primarily by influencing theoretical and doctrinal works of an expository and didactic nature; and secondarily by influencing the decisions of legal operators and courts. This study seeks to explain how the social context influences legal decisions and the formation of the legal System, from a communicational perspective of Law. In order to do so, it will be necessary to set out two epistemological premises of CTL: the semiotic tripartition of the Theory of Law and the legal Order-legal System distinction. (shrink)

El Aprendizaje Basado en Proyectos (ABP), genera contextos integrados de enseñanza primando los procesos de aprendizaje competencial. El ABP favorece el desarrollo de habilidades cognitivas, lingüísticas y sociales del alumnado, fomentando la participación activa, la motivación y la creatividad. Sin embargo, la investigación sobre ABP adquiere matices diferenciales en su implementación en los diferentes niveles educativos. Este estudio descriptivo e inferencial analiza la investigación didáctica publicada, desde 2015 a 2022, siguiendo las directrices PRISMA. Los resultados obtenidos informan de una destacada (...) presencia española en las áreas de las Ciencias Naturales. The aim of this study is to analyze succinctly the ages of nations in the philosophical standpoint of Giambattista Vico, with special reference to the heroic age. It will be interesting to apply these categories onto the athletic Greek experience with the objective of reclaiming the necessary knowledge of the agonal virtue. Such argument is still valuable nowadays because of the dangerous mistakes of strictly idealistic positions.

Vitoria presenta una visión comunitaria del orden internacional y sus enseñanzas serán transmitidas a Suárez, quien, al contrario, presenta una visión societaria del orden internacional. Esta diferencia no es una casualidad, sino un auténtico cambio de paradigma en el sabio granadino, que hace de él un autor más próximo a la modernidad que a la tradición escolástica. No obstante, mantiene una relación íntima y constante con las ciencias desde sus orígenes hasta nuestros días (relación histórica), utiliza el mismo instrumento metodológico, la razón crítica (relación metódica) y recorre el mismo ámbito de la experiencia cognoscitiva humana (relación sistemática). This paper uses a sample of 1243 international firms for the period 2013–2017 to analyse the effect that a greater presence of women in management teams has on business behaviour in relation to labour and human rights, and the mediating role of improved performance in these rights on corporate transparency. The results show that gender diversity in management teams is positively associated with performance in relation to labour and human rights, and that such a performance acts as a mediating factor (...) by fostering a higher disclosure of information regarding these issues. The findings therefore seem to indicate that the presence of women in management teams acts as a driving force for enhanced social responsibility. (shrink)

Psychological flexibility is a key concept of acceptation and commitment therapy. This factor has been linked with psychological wellbeing and associated factors, such as quality of life, in cancer patients. These and other positive results of acceptation and commitment therapy in cancer patients found in previous research could be enhanced by using mhealth tools. A three-arm randomized superiority clinical trial, with a pre-post-follow-up repeated measures intergroup design with a 1:1:1 allocation ratio is proposed. A hundred and twenty cancer patients will (...) be randomly assigned to one of the following interventions: face-to-face ACT + mobile application, face-to-face ACT, and Waitlist control group. The primary expected outcome is to observe significant improvements in psychological flexibility acceptance and action questionnaire- II in the face-to-face ACT + app group, after comparing baseline and post-treatment scores, and the scores will remain stable in the two assessment points, 3 and 6 months after the intervention. Secondary expected outcomes are significant increasing scores in quality of life and post-traumatic-growth, and significant decreasing scores in anxiety and depression, insomnia and fatigue at the same assessment points. Also, it is expected that the scores of this group will be higher than the scores of the face-to-face ACT group and the waitlist control group. This study aims to assess the efficacy of a combined intervention for psychological flexibility and associated symptoms in cancer patients. The results of this protocol may help to consider the use of acceptation and commitment therapy and mhealth applications in cancer settings as a valid therapeutic choice.Clinical Trial Registration[www.ClinicalTrials.gov], identifier [NCT05126823]. Background In Spain, there has been great effort by lawmakers to put Advance Directives into practice since 2002. At the same time, the field of bioethics has been on the rise, a discipline that has spurred debate on the right of patients to exercise their autonomy. Despite all this, the implementation of ADs can be said to have failed in Spain, because its prevalence is very low, there is a great lack of knowledge about them and they have very little (...) impact on clinical decisions. The purpose of this article is to analyze and discuss the main reasons for the failure of ADs in Spain. Main body The main reasons why ADs have no impact on clinical practice in Spain have been fundamentally four: the training of health professionals about the end of life and AD is lacking; there has been no public process to increase awareness about AD, and therefore people know little about them; the bureaucratic procedure to document and implement ADs is excessively complex and cumbersome, creating a significant barrier to their application; in Spain, the remnants of a paternalistic medical culture continue to exist, which causes shared decision-making to be difficult. Conclusion Due to the four reasons mentioned above, AD have not been a useful tool to help honor patients’ autonomous decisions about their future care and, therefore, they have not achieved their objective. However, despite the difficulties and problems identified, it has also been observed that health care professionals and the Spanish public have a very positive view of AD. Having identified the problems which have kept AD from being successful, strategies must be developed to help improve their implementation into the future. (shrink)

The closure of schools as a result of COVID-19 has been a critical global incident from which to rethink how education works in all our countries. Among the many changes generated by this crisis, all teaching became mediated by digital technologies. This paper intends to analyze the activities carried out during this time through digital technologies and the conceptions of teaching and learning that they reflect. We designed a Likert-type online questionnaire to measure the frequency of teaching activities. It was (...) answered by 1,403 teachers from Spain. The proposed activities varied depending on the learning promoted, the learning outcomes, the type of assessment to which the activities were directed, and the presence of cooperative activities. The major result of this study was that teachers used reproductive activities more frequently than constructive ones. We also found that most activities were those favoring verbal and attitudinal learning. The cooperative activities were the least frequent. Finally, through a cluster analysis, we identified four teaching profiles depending on the frequency and type of digital technologies use: Passive, Active, Reproductive, and Interpretative. The variable that produced the most consistent differences was previous digital technologies use These results show that Information and Communication Technologies uses are reproductive rather than constructive, which impedes effective digital technologies integration into the curriculum so that students gain 21st-century competencies. This article analyzes a panel of 550 international firms, for the period 2004 to 2010, to compare the role of female directors in family and non-family firms in promoting responsible practices. Many studies have associated the presence of women on the board with a higher degree of socially responsible commitment. However, we found that this is much less so in family firms than in non-family firms. In family firms, corporate social responsibility commitment does not vary significantly with the presence of (...) female directors, as the latter tend to behave in accordance with the family orientation toward CSR. This orientation depends on the stakeholders being addressed, with greater social responsibility shown toward external stakeholders than internal ones. (shrink)

El motivo de este concienzudo análisis es la publicación en marcha del magno proyecto Más allá de imperios y naciones (4 vols.) iniciado en 2023 y que ya cuenta con dos tomos en el mercado: Rutas, fronteras y complejidad y Singularidad imperial: del Mediterráneo al Atlántico. Esta concepción del estatuto gnoseológico de la historia tiene en Lindos y tornadizos (2016) y (...) en Ambiguus proetus (2019) dos momentos esenciales que dibujan el paso Herranz a su perspectiva (la morfología filosófica) en el debate entre Gustavo Bueno y Ricardo Sánchez Ortiz de Urbina a cuenta del sujeto trascendental. En tal contexto cobran relevancia las hipercategorías formuladas por Pérez Herranz y cuyo estatuto resulta problemático. (shrink)

La propuesta gnoseológica de Ricardo Sánchez Ortiz de Urbina de retirar al Ego trascendental sus funciones gnoseológicas no es inocua para el materialismo. Tiene consecuencias ontológicas y socio-antropológicas. En esta primera parte se ilustran las primeras, discutiendo las diferencias entre el materialismo filosófico del Gustavo Bueno, tal como aparece formulado en sus textos canónicos, y el materialismo fenomenológico, que propone Urbina a propósito de lo «trascedental». Para ello uso como filtro crítico un tercer materialismo, el de Gilles Deleuze, sobre (...) cuya filosofía nómada sólo se efectúan unos apuntes esquemáticos, pero suficientes para «espantar» a los fantasmas de la razón. La referencia a Deleuze en el debate sobre las consecuencias ontológicas que trae el planteamiento de Urbina es obligada, no sólo por las prevenciones que manifiesta Urbina en su texto «a causa de su radicalidad», sino sobre todo, porque sus propuestas estaban ya presentes (como referencia implícita) en las propias formulaciones iniciales del materialismo filosófico. Derek Parfit influentially defends reductionism about persons, the view that a person’s existence just consists in the existence of a brain and body and the occurrence of a series of physical and mental events. Yet some critics, particularly Mark Johnston, have raised powerful objections to Parfit’s reductionism. In this paper, I defend reductionism against Johnston. In particular, I defend a radical form of reductionism that Buddhist philosophers developed. Buddhist reductionism can justify key features of Parfit’s position, such as the claims (...) that personal identity is not what matters and can also be indeterminate. Furthermore, Buddhist reductionism can avoid Johnston’s objections to Parfit’s reductionism. I conclude that reductionists have good reasons to favor Buddhist reductionism over Parfit’s version. El objetivo fundamental de este artículo está dirigido a valorar las funciones de la intertextualidad en la construcción del espacio insular caribeño en WideSargasso Sea, de la escritora dominiquesa Jean Rhys. Por tal motivo se analizaron las relaciones intertextuales entre Jean Eyre, de Charlotte Brontë, y Wide Sargasso Sea, de Jea Rhys, con énfasis en la isla en tanto espacio literario presentado de manera explícita. Como resultado se pudo constatar que la principal función de la intertextualidad en dicho texto responde (...) a la intención calibanesca y desmitificadora de desmonte de los arquetipos en los que la imagen del otro ha sido construida en el discurso del poder. De igual manera, el presente análisis permite develar la riqueza de las connotaciones otorgadas en el texto al espacio isla y a sus significados añadidos. La red de significaciones encontradas refuerza su identidad cultural caribeña. (shrink)

This paper delves into the deconstruction of the notion of responsibility, drawing a correlation with the process of decomposition of the concept of sovereignty as discussed by Derrida in his last research works. We explore Derrida’s consideration of absolute responsibility as no longer passing through the figure of the sovereign. Derrida’s thought takes its distance from the philosophical and hegemonic determination of the notion of responsibility, for the conceptual system of its axiomatic defines responsibility based on the sovereign individual’s freedom (...) and makes responsibility the effect of his power. Yet, this definition condemns ethics to failure, since it does not account for the other supposed in the idea of response. Derrida incorporates absolute singularity, and consequently secrecy, into the structure of responsibility, enabling thought to encounter the absolute other. The text outlines the influence of Nietzsche and Celan in Derrida’s thought and develops an approach that sees in his work the effort to create a poetic revolution in the history of philosophy and knowledge by opening thought to radical alterity. We present the dossier “Studies of Childhood: movements, limits and frontiers”, a theme discussed in the III Brazilian Congress Childhood Studies (CEI). The Congress was organized by members of the Department of Childhood Studies (DEDI) and the Graduate Program in Education (ProPEd) of the State University of Rio de Janeiro. The articles that compose the dossier review the debates that took place during the event in the fields of education, international relations, and ethno-racial issues. In this presentation, inspired by Mario (...) Benedetti's poem “The Bridge”, we explore the power of three words to think about childhood and the relationship we establish with children: borders, strangeness and movements. How many borders do childhood and children cross into the political, cultural, social, and biological order of life? Which movements or changes do they produce, reproduce, and spread? How to destrange childhood, in the sense of challenging the actions and discursive productions that promote exclusions of various forms? Which movements – in the field of research and in society in general – are instituted to encourage the agency of childhood? Starting from the idea that both our culture and our subjectivity are constituted in the relationship between an interior and an exterior that are placed in tension, we draw on philosophy, literature, psychoanalysis, and cultural studies to explore these questions. In this dossier, the texts compose a set that dialogues with the philosophy of childhood and goes beyond conceptual and methodological limits, in the sense of making moves to understand children and childhood through their perspectives, actions, languages and positions, in an objective and subjective form.
